**Update-Passenger Succumbs to Injuries**
 
Troopers Investigating Fatal Motor Vehicle Crash North of Milford
 
Virginio Lopez, 29 of Milford, who was a passenger in the GMC Safari van, died Saturday January 16, 2016 as a result of the injuries he sustained in the Thursday January 14, 2016 crash north of Milford.
 
The investigation is continuing by the Delaware State Police Collision Reconstruction Unit.

The Delaware State Police are releasing the name of the rear seat passenger as Virginio Lopez, 29 of Milford.  He remains in critical condition at Christiana Medical Center

**Update**

  The Delaware State Police Collision Reconstruction Unit is currently investigating a fatal motor vehicle crash that occurred north of Milford Thursday evening.
 
Preliminary investigation indicates the crash occurred around 5:20 p.m. Thursday January 14, 2016 as Julio C. Garcia, 37 of Milford, was operating a 2002 GMC Safari van southbound on Bay Rd (US113/SR1) just north of Cicada Lane.  For unknown reasons, the van drifted into the center media where is struck a road sign, and as Garcia attempted to enter back onto the roadway, he overcorrected and drove off the west side of the road where the van struck a tree.
 
Julio Garcia, who was properly restrained, was removed from the scene by EMS and transported to Bayhealth Milford Memorial Hospital (MMH) where he was treated and released with non-life-threatening injuries.
 
Ruben Martinez, 31 of Milford, was a front seat passenger in the van and was not properly restrained.  He was pronounced dead at the scene.
 
A rear seat adult male passenger in the van, who has yet to be positively identified, was transported initially by EMS to MMH before being airlifted to Christiana Medical Center where he was admitted in critical condition. 
 
Original Post – The State Police Collision Reconstruction Unit is continuing their investigation into this incident and alcohol does not appear to be a factor in this case.  No charges have been filed at this time.  SR1 southbound between Old Cemetery and Cicada Lane was closed for approximately three hours while the crash was investigated and cleared.

The Delaware State Police are currently on the scene of a fatal motor vehicle crash on Bay Road (SR1) southbound just north of Cicada Lane Road

Preliminary investigation indicates the crash involved a single vehicle and one person has died at the scene. The State Police Collision Reconstruction Unit is currently on scene and will assume the investigation.

SR1 southbound traffic is currently being diverted onto Old Cemetery Road north of the crash. Commuters are advised to seek alternate routes of travel.
