On 12/26/2017 at approximately 8:23 a.m., the Milford Police Department Patrol Division was dispatched to Walmart, located at 939 N DuPont Blvd. Milford reference to a criminal mischief to a vehicle. Officers made contact with the victim, who advised that an unknown suspect keyed their vehicle overnight while they was working at Walmart. Officer observed the damage done to the victim’s vehicle and the victim valued the damage at over $1000.00. The victim advised that a few months ago their vehicle was keyed as well. The victim advised that they did not have any known enemies or ex-partners that would have done this to their vehicle. Officers reviewed the surveillance footage from Walmart and observed an unknown male approach the vehicle and appear to do the reported criminal mischief to the vehicle. Officers were able to obtain a tag number for the vehicle that the suspect fled in. Through further investigation, the suspect was identified as James Dagostino, 57 of Ellendale, DE. Investigation revealed that Dagostino allegedly did the criminal mischief to the victim’s car during this incident as well as the one that occurred a few months ago.

Dagostino turned himself into Milford PD later on 12/26/2017 and was charged with Criminal Mischief Over $1000.00 Reckless Damage Property and Criminal Mischief $1000 but less than $5000, Intentionally Damage Property. Dagostino had a presentment through Justice of the Peace Court 3 and was released on $2000.00 unsecured bail with a no contact order with the victim. He was ordered to appear in Justice of the Peace Court 6 at a later date reference to this case.
