On 03/18/2017 at approximately 1159 hours, The Milford Police Department Patrol Division was dispatched to an unauthorized motor vehicle incident at the Brightway Commons Apartment Complex. Investigation revealed that the victim observed extensive damage to their vehicle and advised that the suspect, Lavon Horsey, 37 of Milford, DE, would have been the only one that had access to the vehicle. It was learned by the invetsiagtHorFurther investigation revealed that Horsey was involved in a single motor vehicle collision while he was in possession of the vehicle. The motor vehicle collision occurred when the vehicle left the roadway of North Church Street and collided with a chain link fence that borders the Milford Community Cemetery. Investigation also revealed that Horsey failed to report the collision to the cemetery property to the owner of the property nor the police. The collision caused over $1000.00 in damage to the victim’s vehicle. Officers made contact with Horsey on 03/18/2017, but was transported to the hospital for a mental health evaluation due to statements that he made to officers.
On 03/01/2018, officers were dispatched to the victim’s apartment and located Horsey asleep on the landing outside of the apartment. He was taken into custody without incident and it was learned that he was under the influence of alcohol. He was charged with Unauthorized Use Of A Vehicle Without The Consent Of The Owner, two counts of Criminal Mischief $1000 But Less Than $5000 (Damage Property), Leaving The Scene Of Property Collision Accident, Failure To Provided Information At Collision Scene Resulting In Property Damage, and Failed To Remain Within A Single Lane. Due to his intoxication, Horsey was unable to have a presentment on the charges and was committed to the Department of Corrections in default of $501.00 secured bail. Horsey was later released from the Department of Corrections on $501.00 unsecured bail with a future court date in Kent County Court of Common Pleas reference to this incident.
