On 10/29/2019 at approximately 5:27 p.m., A Milford Police Officer was on a proactive traffic enforcement assignment in the area of Route 113 Northbound (N. DuPont Blvd.) and Airport Rd. Milford, Kent County, DE. While on this patrol, the officer observed a Black Nissan Sentra turning left from Airport Rd onto Route 113 Northbound. The officer observed an equipment violation on the vehicle and conducted a Uniformed Traffic Stop on the vehicle in the area of Route 113 Northbound and Warner Rd. The officer made contact with the operator of the vehicle, who was positively identified as Jonatan Santiago, 22 of Lincoln, DE. During the course of the traffic stop, the officer smelled a strong odor of marijuana emitting from the vehicle. When Santiago was questioned about the marijuana, he admitted that it was under the seat. Santiago also disclosed that he had a firearm underneath the seat as well, but did not have a carry concealed permit for the weapon. Santiago was asked to step out of the vehicle, where he was detained for further investigation. The officer then conducted a search of the vehicle and located an unloaded black in color handgun and a clear plastic bag containing suspected marijuana, which field tested positive for marijuana. The weight of the marijuana was 29 grams. The officer also located drug paraphernalia in the vehicle. Santiago was then transported back to Milford PD for processing.
Santiago was charged with Carrying A Concealed Deadly Weapon A Firearm; Possession, Purchase, Own or Control A Deadly Weapon By Person Prohibit Who Also Possesses Controlled Substance; Possess/Consume Marijuana Other Than Personal Use Quantity; and Possession of Drug Paraphernalia Marijuana Related- Civil Violation. Santiago was also issued a Uniform Traffic Summons for Operating A Vehicle With Improper Window Tinting and Failure To Have Insurance Identification In Possession. Santiago had a presentment through the Justice of the Peace Court 2 where he was released on his own recognizance and ordered to appear in the Kent County Court of Common Pleas at a later date for a preliminary hearing.
